1. Agreement to Terms
By accessing the website at https://viewedat.com and utilizing our visitor intelligence and network analytics tools, you agree to be bound by these Terms of Service and all applicable laws and regulations. You acknowledge that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Description of Services
ViewedAt provides a suite of digital tools designed for Visitor Intelligence and Network Analytics. These services include, but are not limited to:

  • The generation and management of intelligent tracking links.
  • Reporting of network-level metadata (IP addresses, ISP details, and connection types).
  • Proximity-based geolocation mapping (City, Region, and Country).
  • Device and environment analysis (Browser, Operating System, and Device Type).
  • Instant Visitor Alerts via automated notification systems.

3. User Account & Security
To access certain features, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Promptly notify ViewedAt if you discover or suspect any security breaches related to your account or the Service.

4. Subscription Plans and Credits

  • Plan Limitations: Use of the Service is subject to the limits of your selected plan (Free, Pro, or Advanced). The Free Plan is restricted to 10 active tracking links.
  • Credit Consumption: Certain advanced visitor insights require the use of “Credits.” Credits are consumed at the moment a data “unlock” or specific analytics request is processed.
  • Payments: All payments are handled via secure third-party payment processors. By subscribing to a paid tier, you authorize ViewedAt (through our processors) to charge the applicable recurring fees to your designated payment method.

5. Refund and Cancellation Policy

  • General Policy: You may cancel your subscription at any time through your account dashboard.
  • Strict Refund Restriction: Due to the real-time nature of network data and the immediate costs associated with data retrieval, no refunds will be issued for the current billing period if:
  • A single “Credit” has been consumed or utilized for data unlocking.
  • An “Instant Visitor Alert” has been triggered or sent during the period.
  • Finality of Sales: All sales are final once the service has been utilized as described above. Refunds for subscription periods where no service was utilized are at the sole discretion of ViewedAt.

6. Proper Use and Prohibited Conduct

  • You are granted a non-exclusive, non-transferable, revocable license to use the Service strictly in accordance with these terms. You expressly agree not to:
  • Use the Service for any illegal or unauthorized purpose, including stalking, unauthorized surveillance, or harassment.
  • Attempt to bypass technical limitations or extract personally identifiable information (PII) beyond standard network headers.
  • Use the Service to distribute “spam,” malware, or any content that violates third-party rights.
  • Interfere with or disrupt the integrity or performance of the Service.

7. Nature of Data and Accuracy

  • Network Proximity Disclaimer: ViewedAt utilizes IP-based geolocation technology. You acknowledge and understand that:
  • Geolocation data is proximity-based and identifies the network exchange or ISP hub, not a precise physical street address or building.
  • ViewedAt does not provide the specific name or identity of the individual visitor.
  • Information is provided “as is,” and ViewedAt is not responsible for business decisions made based on the inherent technical variances of network metadata.

8. Data Privacy and Compliance (GDPR/CCPA)

  • ViewedAt acts as a Data Processor concerning the visitor data collected through your links. You, the user, act as the Data Controller.
  • You are responsible for ensuring your data collection practices comply with local privacy mandates (e.g., GDPR, CCPA).
  • You must provide your visitors with appropriate notice of the analytics tools you utilize.

9. Limitation of Liability
In no event shall ViewedAt, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or use, resulting from your access to or use of (or inability to use) the Service.

10. Modifications to Service and Terms
ViewedAt reserves the right to modify or discontinue the Service at any time without notice. We may also revise these Terms of Service at any time. By continuing to use the Service after changes are made, you agree to be bound by the revised terms.
